Los fiscales de la Jurisdicción Especial para la Paz (JEP) pidieron este lunes, 31 de julio de 2023, 20 años de cárcel para el coronel retirado del Ejército Publio Hernán Mejía Gutiérrez por 72 falsos positivos (ejecuciones extrajudiciales) cometidas en el conflicto armado, después de que no aceptó los cargos formulados por ese tribunal.
La “acusación que se hace en contra del señor Mejía Gutiérrez es por los delitos de homicidio en persona protegida, desaparición forzada y tortura“, anunció en una rueda de prensa el director de la Unidad de Investigación y Acusación (UIA) de la JEP, Giovanni Álvarez.

Mejía será acusado por “35 hechos y 72 personas, es decir, 72 personas que fueron ejecutadas extrajudicialmente“, especificó Álvarez, quien señaló que se trata de “conductas criminales“ que tienen “todos los elementos de los crímenes de lesa humanidad y los crímenes de guerra“.
El oficial Publio Hernán Mejía fue comandante del Batallón La Popa, con sede en Valledupar, en el norte del país, y es uno de los altos mandos del Ejército que no ha reconocido los crímenes de lesa humanidad imputados por la JEP, que en su proceso ordinario ofrece penas no privativas de libertad a cambio de aportes y reconocimiento de verdad.
Hace un año, este tribunal especial surgido del acuerdo de paz de 2016 con la antigua guerrilla de las FARC imputó a dos coroneles -entre ellos Mejía- y 13 militares más por 127 asesinatos y desapariciones forzadas en la región del Caribe colombiano.
Mejía, sin embargo, no reconoció los hechos y, por ello, la Unidad de Investigación y Acusación (UIA) de la JEP, que cuenta con fiscales propios, presentó este lunes el escrito de acusación en su contra.
En ese escrito, esta instancia considera que el coronel retirado “ideó, diseñó y ejecutó… un plan criminal que consistió en asesinar personas de la población civil y presentarlas como bajas en combate, motivado por darle a la sociedad una falsa percepción de seguridad y con el que pretendió consolidar la imagen de ser el mejor oficial del Ejército“.
El coronel retirado Publio Hernán Mejía, según explicó Álvarez, “siempre tuvo claro quiénes iban a ser sus víctimas: jóvenes con carencias económicas, desempleados -en algunos casos provenientes de familias desestructuradas…- y población campesina e indígena“.
Los fiscales de la JEP deberán probar ahora en un juicio que Mejía cometió estos crímenes y que lo hizo en alianza con las paramilitares Autodefensas Unidas de Colombia (AUC), como aseguran, lo que puede llevarlo a una pena de hasta 20 años de cárcel.
