Cifras que Barbosa dio en su rendición de cuentas “no corresponden a la realidad” según estudio del penalista Humar

En una entrevista con Noticias Caracol, el abogado penalista Fabián Humar, dijo que Colombia está cerca de ser un estado fallido en materia penal.

El Fiscal General Barbosa, en su rendición de cuentas, se autodenominó como el mejor fiscal que hasta ahora ha tenido Colombia, e incluso mencionó que no se arrepentía de las decisiones que a la fecha había tomado pues dijo que “No me arrepiento de una palabra de las que dije. Me voy coherente”.

Fabián Humar, quién es abogado, penalista, consultor y docente, ha tenido que recurrir a tutelas para poder acceder a las cifras reales de los casos que llegan a la Fiscalía General de la Nación.

Con preocupación, manifiesta que las cifras entregadas por el Fiscal saliente Barbosa, no corresponden a la realidad, pues según indica en el medio, más del 80% de las denuncias ciudadanas que llegan a la Fiscalía, son archivadas, y que esta entidad ha perdido aproximadamente 6 de cada 10 procesos, cifra que para el es “escandalosa”.

Adicionalmente, Humar cuestionó el porque se archivan las investigaciones cuando según menciona, la fiscalía cuenta con más de 26 mil funcionarios y aún así no puede encontrar a los responsables de los delitos cometidos: “En un 55,2% de los casos no se sabe quién cometió el delito. Es una locura que la Fiscalía, con un presupuesto billonario, con más de 26 mil funcionarios, no pueda encontrar los responsables”

Cuestionó adicionalmente que “No pasan por el cedazo del control judicial con argumentos tan terribles como el siguiente: que el denunciante no aportó los datos de quien cometió el delito. Esto es una cosa absolutamente ridícula. Porque entonces, cuando a usted lo atraquen en la calle, por favor pare al señor atracador y pídale una fotocopia ampliada al 150% de la cédula para que la Fiscalía pueda determinarlo”.
