Este lunes la Corte Constitucional tumbó el decreto 1085 de 2 de julio de 2023, que declaraba el estado de emergencia en La Guajira y que, así, permitía que el jefe de Estado tuviera la posibilidad de promulgar decretos de ley sin necesidad de que pasaran por la aprobación del Congreso.
Las reacciones políticas tanto positivas como negativas a la declaración de inexequibilidad del decreto no tardaron en llegar.

El ministro del Interior, Luis Fernando Velasco, señaló que “sin cambiar la línea jurisprudencial, la Corte ha reconocido la argumentación del Gobierno nacional cuando decimos que el fenómeno de La Niña, unido al fenómeno de El Niño, puede tener muy graves efectos en la alimentación y en la supervivencia, especialmente de los niños en La Guajira”.
“Nos dan un año para utilizar los instrumentos que hemos planteado en los decretos de emergencia y al cabo del año tenemos que tener listas las leyes que mantengan una acción continuada sobre La Guajira, respetamos la decisión de la Corte y nos adecuamos a ella”, señaló.
Ricardo Bonilla, jefe de la cartera de Hacienda, afirmó que el Gobierno nacional respeta las decisiones del alto tribunal y agregó que “la situación de La Guajira sigue siendo crítica y en emergencia”.
El ministro destacó que es importante que “hayan dejado seguir adelante el tema del agua, que es crucial y el más urgente. […] La Empresa del Agua sigue adelante y de lo que se trata es de empezar a diseñar cómo construir el acueducto de La Guajira que hoy no tiene”.
Juan Loreto Gómez Soto, representante a la Cámara por La Guajira, dijo que la decisión de la corte es “preocupante”. “Desde mi posición como presidente de Comisión IV, insto al Ministerio de Hacienda y otras carteras a tomar medidas urgentes. La situación en la región es crítica y requiere acciones efectivas para mejorar la vida de su población. No podemos dar la espalda a esta crisis humanitaria”.
“Hay que ser muy miserable para estar celebrando que el decreto que ayudaba a la lucha contra el hambre, la enfermedad y la muerte en La Guajira, se haya caído. Llevaron a la gente al sufrimiento y celebran que sigan sufriendo”, afirmó el senador Wilson Arias.
