El pasado 31 julio el juez encargado del caso de José Manuel Gnecco realizó el traslado de un recuso de reposición, concediéndole tres días para contratar a quien sería su nuevo abogado.
Sin embargo, al cumplirse este lapso de tiempo ahora la mora judicial estaría retrasando el inicio del juicio, poniendo en riesgo el debido proceso, por lo que por vencimiento de términos podría quedar libre en medio de la audiencia programa para este viernes 11 de agosto.

“Con la gran cantidad de pruebas en su contra en el homicidio de mi madre, José Manuel Gnecco como medida desesperada, está tratando de que llegue la audiencia de este viernes sin que se haya instalado el juicio. Su objetivo es claro, lograr salir de la cárcel por vencimiento de términos y posiblemente escaparse del país”. Indicó Cristina Serrano, hija de la fallecida María Mercedes Gnecco.
Por eso pide a la fiscalía que se esclarezca el caso y que Jose Manuel Gnneco deje de corromper a la rama judicial.
Cabe recordar que en una primera instancia, la juez sexta penal de control de garantías , negó la libertad de José Manuel Gnecco en el mes de julio, tras la solicitud que realizó su defensa al determinar, que ya se habían vencido los términos de ley.
Días después, el apoderado del presunto victimario, interpuso una tutela debido a que el pasado 10 de julio, el Tribunal Superior de San Andrés, declinó la decisión de trasladar el juicio a Bogotá, al considerar que no hay pruebas que indiquen que el proceso se vería afectado por actos delictivos:
