La Corte Constitucional tumbó uno de los pilares de la reforma a la Procuraduría que impulsó la jefe del Ministerio Público Margarita Cabello y que contó con el apoyo del gobierno de Iván Duque.
Se trata de la facultad que tenía este organismo para destituir, suspender e inhabilitar a funcionarios públicos elegidos por voto popular, como gobernadores, concejales, alcaldes y diputados.

Este jueves con ponencia de los magistrados Juan Carlos Reyes y José Fernando Reyes, el alto tribunal explicó que la Procuraduría no puede tener las funciones de un juez.
En su decisión, el alto tribunal exhortó al Congreso crear un estatuto para los servidores de elección popular en el que se incluya un régimen disciplinario especial que materialice los estándares nacionales e internacionales en materia de protección y garantía de los derechos políticos y electorales.
La Corte dejó claro que la Procuraduría es competente para investigar y juzgar disciplinariamente a los funcionarios públicos, incluidos los servidores de elección popular, salvo que gocen de fuero constitucional.
“Es imperioso asegurar que las decisiones sancionarías de la Procuraduría en contra de los servidores de elección popular no puedan ser ejecutadas antes de que medie un control jurisdiccional. Lo anterior, pues así, por un lado, se respetan las facultades constitucionales de investigación y juzgamiento disciplinario del órgano del control y, por otro lado, se asegura la reserva judicial debido a que la decisión final sobre la imposición de la sanción disciplinaria corresponde a un juez de la República”, señaló la Corte.
