Una investigación militar clasificada, elaborada el 10 de mayo de 2022 por el Batallón de Acción Directa y Reconocimiento No.4 en Puerto Tejada, Cauca, arroja luz sobre un presunto encubrimiento de la Fiscalía en el caso de Francisco Javier Martínez, alias Pacho Malo. Martínez, exdirector del CTI de Buenaventura, fue capturado esta semana por su presunta participación en una banda de contrabando y narcotráfico.

Según el informe, a pesar de las pruebas, testimonios y documentos que vinculan a Pacho Malo con actividades criminales desde 2021, la Fiscalía, liderada por la actual fiscal encargada Martha Mancera, lo habría protegido. El documento también destaca la muerte del investigador Mario Fernando Herrera, quien presentó un informe detallado sobre las actividades de narcotráfico de Pacho Malo y fue asesinado por las disidencias de las Farc como consecuencia de su denuncia.

El informe señala que las disidencias de las Farc controlan el comercio ilegal en el puerto de Buenaventura, y Pacho Malo, con su posición en el CTI, era un contacto clave en operaciones de narcotráfico. Además, revela la persecución laboral y judicial contra agentes del CTI que denunciaron las actividades delictivas de Pacho Malo, orquestada presuntamente por Mancera.
El periodista Daniel Coronell reveló que dos agentes del CTI, Pablo Andrés Bolaños Salas y Fabio de Jesús González León, informaron a Mancera sobre las actividades de Pacho Malo, pero en lugar de actuar contra él, la fiscal encargada inició una persecución contra los denunciantes.

El informe también destaca la presión del agente Víctor Alfonso Forero Cortés, cercano a Mancera, para cambiar la declaración de los informantes. Forero, compañero sentimental de Luisa Obando, fiscal delegada para la seguridad territorial, ha sido señalado por manipulación de pruebas.
Estos hallazgos plantean serias dudas sobre la imparcialidad de la Fiscalía en este caso, especialmente ahora que Pacho Malo está bajo custodia. La sociedad se cuestiona si la interinidad en el liderazgo de la Fiscalía busca mantener el control del caso en manos de Mancera, quien ha sido acusada de encubrimiento y omisión de denuncia.
