La orden de arresto se da por el desacato de una sentencia proferida en agosto de 2019, dicha decisión fue tomada por el juzgado promiscuo del circuito de Chinchiná, Caldas.
El fallo responde al desacato del director de la Policía Nacional, general Óscar Atehortúa y del ministro de Defensa, Carlos Holmes Trujillo por el «incumplimiento a un fallo de tutela proferido el 26 de agosto de 2019 que los ordenaba a promover el curso de ascenso al mayor Moreno Salazar«.
En el documento se puede leer que «a pesar de haber sido sometido al procedimiento de evaluación de trayectoria profesional para ser llamado al curso de ascenso, (Moreno Salazar) fue notificado el 25 de febrero de 2020 que su nombre no había sido recomendado para presentar el concurso previo al curso de capacitación para ascenso al grado de teniente coronel (..)»
Este fue el principal motivo para que el juez, César Augusto Cruz, les impusiera un arresto por tres días «que deberán cumplir en la Escuela de Carabineros o en Institución Pública similar al respecto en la ciudad Bogotá».
Finalmente, el juzgado también impuso una multa de dos salarios mínimo para cada uno e indicó que se les seguirá sancionando por el mismo motivo hasta que cumplan en su totalidad la sentencia.
