El pasado 29 de octubre un fallo de tutela le ordenó a la Policía Nacional suspender el uso de agentes químicos durante las protestas sociales, sin embargo, en las últimas horas el fallo inicial fue anulado por el Tribunal Superior de Bogotá.
La razón de esta decisión responde a que, según el Alto tribunal, al realizar el fallo no se tuvo en cuenta el concepto del Ministerio de salud.
«Resulta obligatoria la vinculación del Ministerio de Salud a la acción, a fin de que se pronuncie sobre los hechos narrados en la acción e indique si existen evidencias o no que correlacionen el uso de los agentes químicos para el control de protesta y el riesgo de contagio o mayor severidad de síntomas por COVID-19», señala el fallo
Conforme a las declaraciones del Tribunal, la omisión ante la vinculación del Ministerio de salud y de interior afectó el derecho fundamental al debido proceso.
Este sería el documento con el cual se tumba la prohibición de gases lacrimógenos en las manifestaciones.

Según RCN radio, el expediente volvería al juzgado quinto laboral de Bogotá, en donde sería estudiado nuevamente con los conceptos de los ministerios de Salud y del Interior.
